1. About these terms
These terms form the agreement between you and Song My Story when you order a custom song through songmystory.com. By placing an order you accept them. If you are ordering on behalf of a company, you confirm you are authorised to do so.
2. Your account
You need an account to order, complete your story questionnaire and receive your song. Keep your sign-in details secure and give us accurate information. You are responsible for activity that happens under your account.
3. Ordering and payment
Prices are shown in your local currency and include any applicable taxes unless stated otherwise. Payment is taken in full up front through our payment processor. Your order is confirmed once payment succeeds and your order status moves to "Order Received". We begin work once you have submitted your story questionnaire.
4. What you provide
You confirm that the stories, names, photographs and other material you send us are yours to share, are accurate to the best of your knowledge, and do not infringe anyone else's rights. We may decline or cancel an order for material that is unlawful, hateful, harassing, defamatory, sexually explicit, or that we reasonably believe would harm a third party. Where a song is about another person, you confirm they would not object to it being written.
5. Delivery, revisions and cancellation
Estimated delivery times are shown with each package and start from the moment your completed questionnaire is received. Priority delivery is included where the package says so. Delivery is digital: your files appear in your dashboard and we email you when they are ready.
Each song includes one round of reasonable lyric revisions before recording. Because every song is custom-made to your brief, once writing has begun the order cannot be cancelled for a change of mind, and this replaces any statutory cooling-off period to the extent the law allows. If we have not started work, contact us and we will refund you in full. If a delivered file is faulty or clearly does not match the brief you gave us, we will fix it or refund you. Nothing here limits rights you have under consumer law that cannot be excluded.
6. Your licence to use the song
Once your order is paid in full, we grant you a perpetual, worldwide, non-transferable premium personal-use licence in the finished song, recording, artwork, lyric sheet and lyric video. That means you may:
- play, download and keep the song for yourself, forever;
- give it as a gift and share it privately with family and friends;
- play it at your own private event — a wedding, birthday, anniversary, memorial or family gathering;
- share it on your personal social media, including in a video of your own occasion, with a credit to Song My Story where practical.
The licence does not cover commercial use. Without our written permission you may not sell, licence or sub-licence the song, use it in advertising or in any paid or monetised content, use it as a soundtrack in a commercial production, register it with a collecting society or content-ID system, distribute it to streaming platforms yourself, or claim authorship. If your package includes streaming distribution, we handle that release for you.
7. Our rights
We and our songwriters retain copyright and all other intellectual property in the composition, lyrics, master recording and artwork. We keep the right to hold a copy of the work for our records and, unless you ask us not to, to feature a short excerpt of the song and a general description as a portfolio sample or in marketing. Tell us at any time and we will remove it. Your personal details and the private story behind the song are never published without your consent.
8. Gift reveal and shared links
The private reveal page is generated for you to share as you choose. Anyone with the link can view that page, so share it only with people you intend to. Ask us and we can disable a link.
9. Availability and support
We work hard to keep the site available but we do not guarantee uninterrupted access, and we may carry out maintenance or change features. Support is by email and we aim to reply within two business days.
10. Liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability arising from an order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss, or for loss caused by inaccurate information you supplied.
11. Privacy
We handle your personal data as described in our Privacy Policy, which forms part of these terms.
12. Changes and governing law
We may update these terms; the version in force when you place an order is the one that applies to it. These terms are governed by the law of South Australia, Australia, and the courts there have jurisdiction, without affecting mandatory consumer protections in your country of residence.
